1. INTRODUCTION

The Deep Layer Lab Kft. (hereinafter referred to as the Data Controller) website (https://www.deepplayerlab.io, hereinafter referred to as the Website) uses cookies, scripts and similar technologies (hereinafter referred to as the Cookies). Some cookies are also placed by third -party service providers. The purpose of this Cookie Notice (hereinafter referred to as the Notice) is to provide visitors to the Website with a transparent explanation of the use of cookies , their legal basis and the rights of visitors.

This Notice is about Deep Layer Lab Kft. General Terms and Conditions (v1.0 or later; hereinafter: GTC) and shall be interpreted together with Section 11 of the GTC and the Data Protection Notice in Annex 1. The Data Protection Notice in Annex 1 shall govern the detailed data protection provisions – in particular the possibilities of legal remedies and the detailed manner of exercising the rights of the data subject.

1.2. Governing laws

a) Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR), in particular Article 6 thereof;

b) Section 155 (4) of Act C of 2003 on Electronic Communications ( Eht .);

c) Section 13/A of Act CVIII of 2001 on certain issues of electronic commerce services and services related to the information society ( Ekertv .);

d) Directive 2002/58/EC of the European Parliament and of the Council ( ePrivacy Directive);

e) Act CXII of 2011 on the right to informational self-determination and freedom of information ( Infotv ).

2. BASIC CONCEPTS

2.1 . Cookies

A cookie is a small text file that the Website sends to the visitor’s device (computer, mobile phone or other internet-enabled device) and that the browser stores on the hard drive. The information stored in the cookie can be sent back to the Data Controller’s servers on a subsequent visit, or – in the case of a cookie placed by a third party – to the servers of the third party concerned.

2.2. Script

A script is a piece of program code that ensures the proper and interactive functioning of the Website. Scripts can run on the Data Controller’s server or on the visitor’s device.

2.3. Web beacon (web beacon , pixel tag)

A web beacon is a small element (usually an image or text) that is mostly invisible to the visitor and is used to measure traffic to the Website. A web beacon can store various data about the visitor.

3. COOKIE CATEGORIES AND LEGAL BASES USED

3.1. Strictly necessary (functional) cookies

Legal basis: GDPR Article 6 (1) point f) (the Data Controller’s legitimate interest in the proper operation of the Website), and Ekertv . Section 13/A. (3) paragraph.

These cookies are strictly necessary for the proper functioning of the Website; their task is to ensure the functioning of certain functions (e.g. session management, access management, security functions, storage of cookie consent). The placement of these cookies does not require consent from the data subject; they are used by the Data Controller on the basis of the exemption set out in Article 5(3) of the ePrivacy Directive.

3.2. Statistical (analytical) cookies

Legal basis: GDPR Article 6 (1) point (a) (explicit consent of the data subject), as well as the consent requirement pursuant to Section 13/A of the Ekertv and Article 5 (3) of the ePrivacy Directive.

Statistical cookies collect anonymous or pseudonymous data about the use of the Website, which is necessary for the Data Controller to optimize the Website. The placement of these cookies requires the prior, express consent of the visitor.

3.3. Marketing and personalization cookies

Legal basis: GDPR Article 6 (1) ( a) (explicit consent of the data subject).

Marketing and personalization cookies are used to create user profiles for the purpose of displaying advertisements or tracking the visitor across websites. The Data Controller does not currently use these types of cookies ; if they are introduced in the future, the detailed cookie list will be updated accordingly and the Data Controller will request the visitor’s prior, express consent for the application.

4. COOKIES USED ON THE WEBSITE

Important note: the Website is currently in a development / refinement phase. The cookie list in this section provides temporary, general information about the cookie categories used until the final launch. At the same time as the Website goes live, the Data Controller will replace the list below with a detailed technical table ( per service provider , cookie name, expiration date and purpose) and update this Notice accordingly.

4.1. Cookie categories and technologies currently used by the Data Controller

a) Session and functional cookies. First-party cookies necessary for the basic functioning of the Website (navigation, content display) . By type: session cookies (deleted when the browser is closed) and short-term persistent cookies .

b) Cookies used by the content management system (WordPress / Elementor ) . The Website is built on the WordPress content management system and the Elementor page editor. The cookies placed by them are used for the purpose of interface display, template management, and ensuring the editorial and visitor experience. The vast majority of these are functional cookies exempted under Article 5(3) of the ePrivacy Directive.

c) Cookie management platform ( Complianz ) cookies. Cookies used to manage the visitor’s cookie consent (e.g. cmplz_functional , cmplz_statistics , cmplz_preferences , cmplz_marketing ), which record the fact and content of the consent. Their lifespan is typically 365 days. They are functional in nature: they serve the operation of the cookie management system and, as such, can be placed without consent.

d) Calls made by an external web font provider (Google Fonts ). The Website may use the Google Fonts service to display web fonts. The Data Controller strives to serve web fonts locally ( self-hosted ) or – if this is done through Google servers – only with the express consent of the visitor, in view of the Munich The findings of the Landgericht 3 O 17493/20 judgment, which classified the direct loading of Google Fonts as a violation of the GDPR due to the transmission of the visitor’s IP address to a third country without consent.

e) Security ( Cloudflare ) cookies. The Website may also use the Cloudflare security service (e.g. cf_clearance cookie), which is a strictly necessary cookie for abuse prevention and DDoS protection.

4.2. Statistical and marketing cookies

The Data Controller decides on the introduction of statistical (e.g. Matomo , Plausible or Google Analytics ) and – if applicable – marketing cookies when the Website goes live. When these types of cookies are introduced, this Notice will be updated and visitors will be asked for their prior, express consent via the cookie management platform.

5. GIVING AND WITHDRAWING CONTRIBUTION

5.1. Giving consent

When visiting the Website for the first time, a cookie banner appears for the visitor, in which the visitor can give or refuse consent to the placement of non-essential (statistical, marketing) cookies, broken down by category . The consent becomes valid by pressing the “Save settings” (or similar name) button. Strictly necessary cookies are placed even without the visitor’s consent.

5.2. Withdrawal of consent

The visitor may withdraw their consent at any time, without giving any reasons, free of charge, via the cookie settings interface continuously available in the footer of the Website, or by deleting cookies in their browser settings . The withdrawal of consent does not affect the lawfulness of the data processing carried out on the basis of consent before the withdrawal.

5.3. Duration of storage of consent

The fact and content of the consent given in the cookie banner is stored by the Data Controller via technical cookies placed by the cookie management platform ( Complianz ) for a maximum of 365 days; after which the visitor will be contacted again.

6. DISABLE AND DELETE COOKIES

The visitor can automatically or manually delete cookies through the settings of his/her internet browser , or he/she can have certain cookies not placed. It is also possible for the browser to warn him/her every time a cookie is placed. A detailed description of these options is available in the browser’s Help function.

The visitor acknowledges that if cookies are disabled, some functions of the Website may not function properly.

7. RIGHTS OF THE DATA SUBJECT WITH REGARD TO DATA PROCESSING RELATED TO COOKIES

The visitor has the following rights under Chapter III of the GDPR and the Information Act :

a) right to information and access (Articles 13-15 GDPR);

b) right to rectification (Article 16 of the GDPR);

c) right to erasure (“to be forgotten”) (Article 17 of the GDPR);

d) right to restriction of data processing (Article 18 of the GDPR);

e) right to data portability (Article 20 of the GDPR);

f) right to object (Article 21 of the GDPR);

g) right to withdraw consent (Article 7(3) GDPR ) .

The detailed rules for exercising data subject rights and the method of submitting requests are contained in the Data Controller’s General Data Processing Information in Annex 1. Requests can be submitted to the email address info@deeplayerlab.io or by post to the registered office of the Data Controller.

8. LEGAL REMEDIES

In the event of a violation of their data protection rights, the visitor may file a complaint with the National Authority for Data Protection and Freedom of Information (NAIH) or with a court:

The visitor may exercise the right to appeal to the court pursuant to Article 79 of the GDPR and Section 23 of the Infotv ; the lawsuit may also be initiated – at his/her choice – before the court of his/her place of residence or stay.

9. AMENDMENT OF THE INFORMATION

The Data Controller reserves the right to modify this Notice at any time. The current version will be published on the Website. Upon the Website’s launch or in the event of a significant change in the scope of cookies , the Data Controller will immediately update the Notice and direct visitors to a new consent request interface via the cookie banner.
